These Terms of Service ("Terms") govern your use of PartyShots (the "Service"), a web-based event photobooth operated by Brody Technologies, LLC, an Idaho limited liability company ("PartyShots," "we," "us"). By purchasing an event, signing in, scanning an event QR code, or uploading content, you agree to these Terms. If you do not agree, do not use the Service. By using the Service, you also agree to our Privacy Policy, which is incorporated into these Terms by reference.
1. The Service
PartyShots lets event organizers ("Hosts") create a themed photobooth web page for an event. Attendees ("Guests") can capture photos and short videos, apply decorative frames, and submit them. Submitted media is transferred directly to the Host's own Google Drive, and the live event gallery is served straight from that Drive. PartyShots stores no media of any kind, not even thumbnails. PartyShots is a software tool: we are not an event photography service, and we do not operate, supervise, or host events.
Guest acceptance: When Guests access an event page (for example, by scanning a QR code), a link to these Terms is presented before they submit any media. Using the Service constitutes acceptance.
2. Host accounts
Hosts sign in with Google. You are responsible for activity on your account and for keeping access to your Google account secure. You must be at least 18 years old to purchase an event or create a Host account.
3. Payment and activation
Events are purchased for a one-time fee shown at checkout. Payments are processed by Stripe; we never receive your card details. There are no subscriptions and no automatic renewals. An event activates once payment is complete and the Host has connected Google Drive, and the live gallery remains open from activation until 72 hours after the event date (or 72 hours after activation when no event date is set). Hosts may end an event early at any time.
Refunds: If your event did not function as expected due to a defect or failure on our part, contact partyshots.support@gmail.com within 30 days of your event date. Where we determine a material failure occurred on our end, we will issue a full or partial refund at our discretion. We do not issue refunds for user error, venue connectivity issues, or change-of-mind cancellations.
4. Google Drive delivery and gallery access
Guest media is delivered directly to a folder in the Host's Google Drive using the narrowest permission Google offers (access only to files PartyShots creates). The Host (not PartyShots) owns and controls that folder and everything in it, and the folder stays private in the Host's Drive: PartyShots does not make it public or link-shared. To power the live gallery without storing any media ourselves, gallery images and videos are streamed on demand from the Host's Drive through our access-controlled gallery endpoint, which enforces the event's settings (including any Host-set PIN, moderation decisions, and event expiry) on every request. Hosts are responsible for: (a) keeping their Google account in good standing, (b) keeping their Drive connection authorized, and (c) having sufficient Google Drive storage space. If a Host's Drive is full, disconnected, or otherwise unavailable, media may not be deliverable.
5. PartyShots is not a storage or backup service: media may be lost
To the maximum extent permitted by law, PartyShots is not responsible for lost, deleted, undelivered, corrupted, or inaccessible photos or videos, for any reason. That includes (without limitation) device or browser failures, network problems at the venue, full or disconnected Google Drive accounts, third-party outages (Google, Cloudflare, Stripe), Guest error, Host moderation decisions, event expiry, and our scheduled deletion of gallery records after an event ends. The Service performs a one-way, best-effort transfer of media to the Host's Drive. We keep no copies of any kind (not even thumbnails), and once an event ends we permanently delete our text-only gallery records. Guests who want to keep a photo must save it to their own device before the event ends. We recommend Hosts verify that uploads are arriving in their Drive at the start of their event.
6. Content ownership and license
Guests retain whatever rights they hold in the media they capture. By submitting media through an event, Guests grant the Host the right to receive, keep, and use it, and grant PartyShots a limited, temporary license to process and display the media solely to operate the Service (for example, showing it in that event's live gallery). This license ends when the media is no longer accessible through the Service.
7. User content: platform, not publisher
PartyShots is an interactive computer service within the meaning of 47 U.S.C. ยง 230: a platform that provides technical tools for Hosts to run events and for Guests to submit content. PartyShots does not create, select, or editorially control user content and is not the publisher or speaker of any user content. All content is created and submitted by users.
PartyShots does not pre-screen uploads and is not responsible or liable for any user content, including content that is offensive, infringing, unlawful, or otherwise objectionable. The Host of an event is the information content provider for that event and bears primary responsibility for its content. By creating an event, Hosts represent that they have obtained or will obtain any necessary consent from individuals who appear in or submit media. Hosts must supervise their events using the provided moderation tools (hide, delete, approval mode, PIN protection) as they see fit.
We provide a reporting mechanism, and items that receive multiple independent reports are automatically hidden pending Host review. We may, but are not obligated to, investigate reports, remove content, or suspend events we believe violate these Terms or applicable law. Our discretionary moderation decisions do not make us a publisher or speaker of user content and do not waive the platform protections described above. Important: Section 230 does not limit our copyright obligations. See Section 8 for our DMCA process, which applies separately and is required for us to maintain safe harbor protection.
8. DMCA / copyright takedown
PartyShots respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. ยง 512). Although we do not store full-resolution media, content may be displayed through the live gallery served from the Host's Google Drive. Both display and transmission involve copyrighted material and are subject to copyright law. We therefore maintain a designated agent and DMCA process as required to qualify for the safe harbor protections under ยงยง 512(a) and 512(c). If you believe content displayed or transmitted through our Service infringes your copyright, send a written notice to our designated agent:

Your notice must include: (a) a description of the copyrighted work; (b) identification of the infringing material and its location; (c) your contact information; (d) a statement of good faith belief; (e) a statement, under penalty of perjury, of accuracy and authorization; and (f) your physical or electronic signature.
Counter-notices: If you believe your content was removed in error, you may submit a counter-notice under 17 U.S.C. ยง 512(g). PartyShots may restore removed content after receiving a valid counter-notice and providing the complaining party 10-14 business days to seek a court order. Repeat infringers: We will terminate accounts of users we determine to be repeat infringers.
9. Acceptable use
You agree not to upload or use the Service to share content that:
- is unlawful, threatening, harassing, or hateful;
- is sexually explicit, or exploits or endangers minors in any way;
- infringes someone else's copyright, trademark, or privacy rights;
- contains malware or attempts to disrupt or abuse the Service (including automated uploading, scraping, or circumventing rate limits or PIN protection).
Guests should only appear in or submit photos of people who consent to being photographed and shown in the event gallery. We may suspend or terminate events or accounts that violate this section, without refund.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR AVAILABLE AT ANY PARTICULAR TIME, INCLUDING DURING YOUR EVENT.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARTYSHOTS' TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US FOR THE AFFECTED EVENT (OR $4.99 IF YOU PAID NOTHING OR THE CLAIM DOES NOT RELATE TO A SPECIFIC EVENT). WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST MEMORIES, LOST DATA, LOST PROFITS, OR EMOTIONAL DISTRESS, EVEN IF ADVISED OF THE POSSIBILITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
12. Class action waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND PARTYSHOTS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. IF THIS SPECIFIC PROVISION IS FOUND TO BE UNENFORCEABLE, THEN THE ENTIRETY OF THE DISPUTE RESOLUTION PROVISION IN SECTION 14 SHALL BE VOID.
13. Indemnification
Hosts agree to indemnify, defend, and hold PartyShots, Brody Technologies, LLC, and their respective officers, directors, employees, and agents harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) their event; (b) content uploaded at their event; (c) their breach of these Terms; or (d) claims by Guests or third parties relating to the Host's or their Guests' actions, except to the extent caused by PartyShots' own negligence or willful misconduct.
14. Dispute resolution
Informal resolution: Before filing any legal claim, you agree to contact us at partyshots.support@gmail.com with a written description of the dispute. We will try to resolve it informally within 30 days.
Arbitration: If we cannot resolve the dispute informally, you and PartyShots agree to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than litigation in court. The arbitration will be conducted in Idaho, unless you and we agree otherwise. Judgment on the award may be entered in any court with jurisdiction.
Exceptions: Either party may bring claims in small claims court for disputes within that court's jurisdiction, and either party may seek injunctive or other equitable relief in any court of competent jurisdiction to address infringement, misappropriation, or violation of intellectual property rights.
Opt-out: You may opt out of this arbitration agreement by sending written notice to partyshots.support@gmail.com within 30 days of first accepting these Terms. Your opt-out will not affect any other provision of these Terms.
15. Governing law
These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles. For any claims not subject to arbitration (Section 14), you consent to exclusive jurisdiction and venue in the state and federal courts located in Boise, Idaho.
16. Force majeure
PartyShots is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, civil unrest, governmental action, internet or power outages, or failure of third-party services (including Google, Cloudflare, Stripe, and Resend). We will make reasonable efforts to resume service as soon as practicable.
17. Changes and termination
We may update these Terms from time to time. The "Last updated" date above will change, and we will notify Hosts by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance. We may discontinue the Service with at least 30 days' written notice to Hosts with active paid events; active paid events will be honored or refunded.
18. General
Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and PartyShots regarding the Service. Severability: If any provision is held unenforceable, it will be modified to the minimum extent necessary to be enforceable, and the remaining provisions stay in effect. No waiver: Our failure to enforce any provision is not a waiver of it. Assignment: You may not assign your rights without our consent; we may assign ours without restriction. Notices to PartyShots must be sent to partyshots.support@gmail.com; notices to you go to the email associated with your Host account.
